Elite Experiences — Terms & Conditions

Elite Experiences is a verified dining experience platform that allows diners to share honest experiences about restaurants they have visited.

The purpose of Elite Experiences is to help other diners decide whether a restaurant is worth visiting or not.

Your experience may help someone understand what was good, what was not good, what to expect, and whether they should go or skip.

Access to Elite Experiences may be invite-only, limited, or subject to approval by Explorex.

Submitting an invitation request does not guarantee access.

We may accept, reject, pause, restrict, suspend, or revoke access at our discretion to protect the quality, safety, and trust of the platform.

By using Elite Experiences, you confirm that:

1. You are at least 18 years old; or
2. You are using the platform with the consent and supervision of a parent or legal guardian.

You also confirm that the information you provide to us is true, accurate, and belongs to you.

When you request an invitation, receive an experience link, or submit an experience, we may collect and process information including:

• Full name
• Email address
• Phone number
• WhatsApp number
• User ID or diner ID
• Restaurant name
• Restaurant ID
• Order ID
• Visit date and time
• Recommendation status
• Experience title
• Experience body
• Photos uploaded by you
• Link click status
• Submission status
• Moderation status
• Technical and usage information

We use this information to operate Elite Experiences, verify dine-in visits, send experience-sharing links, collect responses, moderate content, improve the platform, and provide related services.

Our handling of personal data is also governed by our Privacy Policy.

By providing your phone number and accepting these Terms, you consent to receive communications from Explorex through WhatsApp, SMS, email, or other communication channels for purposes related to Elite Experiences.

These communications may include:

• Invitation updates
• Experience-sharing links
• Visit-related messages
• Service updates
• Platform updates
• Moderation updates
• Important account or access-related communication

You may opt out of non-essential communication where applicable.

If a WhatsApp message includes an opt-out instruction such as “Reply STOP to opt out”, you may use that option to stop receiving such messages.

Elite Experiences is intended for real diners sharing real experiences from actual dine-in visits.

You agree that you will only submit experiences about restaurants you have genuinely visited.

You must not submit fake, copied, misleading, fabricated, paid, manipulated, or dishonest experiences.

You must not submit an experience on behalf of another person unless you are clearly authorised to do so.

When submitting an experience, you may be asked to provide:

• Whether you recommend or do not recommend the restaurant
• A title for your experience
• A written explanation of your experience
• Optional photos

Your experience may be positive, negative, or mixed.

We encourage honest, specific, and useful experiences.

You should explain what worked, what did not work, and whether you would recommend the restaurant to another diner.

You agree that your content must be honest, respectful, lawful, and based on your actual experience.

You must not submit content that:

1. Is false, misleading, or fabricated;
2. Is defamatory, abusive, threatening, hateful, obscene, vulgar, or harassing;
3. Contains personal attacks against restaurant staff, diners, owners, or any individual;
4. Reveals private or personal information about another person;
5. Contains discriminatory remarks based on religion, caste, race, gender, sexuality, disability, nationality, or any protected characteristic;
6. Violates any law or regulation;
7. Infringes intellectual property or privacy rights of any person;
8. Contains spam, promotional material, irrelevant content, or advertisements;
9. Is submitted in exchange for undisclosed payment, gifts, benefits, favours, discounts, or consideration;
10. Is intended to blackmail, threaten, unfairly pressure, or extort a restaurant, staff member, user, or third party;
11. Contains malware, harmful code, or suspicious links;
12. Is otherwise harmful to the integrity and trust of Elite Experiences.

Elite Experiences allows honest positive, negative, and mixed experiences.

You may recommend a restaurant.

You may also choose not to recommend a restaurant.

However, if you are sharing a negative or mixed experience, you should keep it factual, specific, and based on what actually happened.

For example, you may share details such as:

• What you ordered
• What stood out
• What disappointed you
• Whether service was slow
• Whether the food, drinks, vibe, or value met your expectations
• Whether you would go back

You should avoid exaggerated, abusive, defamatory, or personal remarks.

If you upload photos, you confirm that:

1. You took the photos or have the right to upload them;
2. The photos relate to your dining experience;
3. The photos do not violate anyone’s privacy;
4. The photos do not contain illegal, offensive, explicit, or harmful content;
5. The photos do not infringe any third-party rights.

We may reject, remove, hide, or restrict photos that violate these Terms or our moderation standards.

Experiences submitted by you may be reviewed, moderated, approved, rejected, displayed, distributed, or removed by Explorex.

If approved, your experience may be shown on Elite Experiences, restaurant pages, feeds, curated lists, marketing surfaces, or other Explorex-owned digital properties.

We will not publicly display your phone number, email address, internal user ID, or internal order ID.

Your name, display name, profile identity, experience title, experience body, recommendation status, and uploaded photos may be displayed if your experience is published.

You continue to own the content you submit.

However, by submitting an experience, title, body, photo, or any other content to Elite Experiences, you grant Explorex a non-exclusive, worldwide, royalty-free, sublicensable, transferable licence to host, store, reproduce, display, publish, distribute, modify for formatting, promote, and use such content in connection with Elite Experiences and Explorex services.

This licence allows Explorex to operate, improve, market, and promote Elite Experiences.

We will not materially change the meaning of your experience, but we may edit formatting, correct display issues, crop images, resize images, or adapt the content for platform presentation.

Elite may introduce features where restaurants can boost, sponsor, or amplify approved experiences.

If your experience is used in a paid, sponsored, or boosted placement, Elite may mark it with labels such as “Boosted”, “Sponsored Experience”, or similar disclosures.

Elite may also introduce points, badges, rewards, recognition, curator status, or other benefits in the future.

Such programs may be governed by additional terms, eligibility criteria, and platform policies.

Unless expressly communicated by Explorex in writing, submitting an experience does not guarantee money, points, rewards, restaurant invitations, visibility, or any benefit.

Explorex may review, approve, reject, edit for formatting, hide, restrict, or remove any content at its discretion.

We are not obligated to publish every experience submitted.

We may moderate content before or after publication.

We may remove content if we believe it violates these Terms, applicable law, restaurant or user safety, privacy rights, platform integrity, or the trust of Elite Experiences.

Restaurants may be allowed to respond to experiences, report content, or raise disputes.

If a restaurant disputes your experience, Explorex may review the content and take appropriate action.

A restaurant’s disagreement with an experience does not automatically mean that the experience will be removed.

Explorex may keep, edit for formatting, hide, restrict, or remove disputed content depending on the facts, platform policy, and applicable law.

You must not use Elite Experiences to:

1. Submit fake experiences;
2. Create multiple accounts to manipulate perception;
3. Threaten restaurants with negative experiences;
4. Demand money, free food, discounts, or benefits in exchange for positive or negative content;
5. Post content for undisclosed payment or benefits;
6. Harass restaurant staff, users, owners, or third parties;
7. Misuse experience links;
8. Attempt to access another user’s experience link;
9. Interfere with the platform’s systems, APIs, or security;
10. Scrape, copy, or commercially exploit platform content without permission;
11. Violate any applicable law.

Each experience link is unique and linked to a specific user, order, restaurant, and visit.

You may submit only one experience per verified experience link.

Experience links may expire after a defined period.

If your link has expired, has already been used, or is invalid, you may not be able to submit an experience through that link.

Experiences on Elite are submitted by diners and reflect individual opinions.

Explorex does not guarantee the accuracy, completeness, or reliability of any user-submitted experience.

Explorex does not endorse any restaurant solely because it appears on Elite Experiences.

Restaurants are independent third parties. Explorex is not responsible for the food, service, pricing, safety, availability, quality, or conduct of any restaurant.

We may modify, pause, suspend, discontinue, or restrict any part of Elite Experiences at any time.

We do not guarantee that the platform will always be available, uninterrupted, secure, or error-free.

We may change features, access rules, eligibility criteria, content policies, or platform functionality from time to time.

Explorex may receive visit-related information from its own systems, restaurant systems, or partner integrations.

While we take reasonable steps to maintain accurate records, we do not guarantee that all visit, order, restaurant, or diner information will always be complete, accurate, or error-free.

If you believe any information linked to your experience is incorrect, you may contact us.

Our collection, use, storage, disclosure, and protection of your personal data is governed by our Privacy Policy.

By using Elite Experiences, you also agree to our Privacy Policy.

You may contact us for privacy-related requests, corrections, grievances, or concerns using the contact details provided below.

We may suspend, restrict, or revoke your access to Elite Experiences if we believe that:

1. You violated these Terms;
2. You submitted fake, abusive, or misleading content;
3. You misused the platform;
4. You attempted to manipulate experiences, recommendations, or restaurant perception;
5. Your conduct harms users, restaurants, Explorex, or the integrity of the platform;
6. We are required to do so by law, regulation, court order, or government direction.

All rights in the Elite Experiences platform, including design, branding, software, logos, trademarks, product flows, databases, and technology, belong to Explorex or its licensors.

You may not copy, modify, distribute, reverse engineer, or commercially exploit any part of Elite Experiences without prior written permission from Explorex.

Elite Experiences may use or integrate with third-party services, including WhatsApp, cloud storage providers, analytics tools, messaging providers, or hosting providers.

Your use of such third-party services may also be subject to their own terms and policies.

Explorex is not responsible for third-party service interruptions, errors, delays, or failures.

To the maximum extent permitted by law, Explorex shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to your use of Elite Experiences.

Explorex is not responsible for:

1. Restaurant service, food, pricing, conduct, or safety;
2. User-submitted content;
3. Loss of data due to technical failures;
4. WhatsApp or third-party delivery failures;
5. Decisions made by diners or restaurants based on experiences;
6. Temporary unavailability of the platform.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

You agree to indemnify and hold harmless Explorex, its directors, employees, officers, affiliates, partners, and representatives from any claims, losses, liabilities, damages, costs, or expenses arising from:

1. Your violation of these Terms;
2. Your submitted content;
3. Your misuse of Elite Experiences;
4. Your violation of applicable law;
5. Your infringement of third-party rights;
6. Any false, misleading, defamatory, or unlawful content submitted by you.

We may update these Terms from time to time.

The updated version will be posted on the platform with the revised “Last updated” date.

Your continued use of Elite Experiences after updated Terms are posted means you accept the updated Terms.

These Terms are governed by the laws of India.

Subject to applicable law, the courts in Bengaluru, Karnataka shall have jurisdiction over disputes arising from or relating to these Terms or Elite Experiences.

By requesting an invitation, accepting these Terms, accessing Elite Experiences, or submitting an experience, you confirm that you have read, understood, and agreed to these Terms.
